January 19, 1968, following a trial by jury, plaintiff in error, Mark J. Leroux (hereinafter defendant), was convicted of two counts of first-degree murder, in violation of sec. 940.01, Stats. Defendant was sentenced to consecutive terms of life imprisonment. January 17, 1969, a motion was served and filed in the circuit court for Portage county on behalf of the defendant to vacate the jury verdicts on both counts and for a new trial. Following an evidentiary hearing, defendants motion was denied by order of the circuit court dated October 22, 1969. Separate writs of error were issued to review the judgment of conviction and order denying defendants motion for new trial.
